What Anthropic's Claude Max Lawsuit Actually Claims
Anthropic is facing two lawsuits over how it advertises its Claude Max plans. A single subscriber filed a proposed class action in June 2026, and a broader class action followed on September 8, 2026. Both turn on the same question: what "5x" and "20x" more usage actually means once five-hour session windows and weekly caps are applied. Updated October 30, 2026: here is what the complaints allege, what Anthropic discloses, and how to check what a usage-based AI plan really gives you.
⚡ Quick facts
- The plans: Claude Max costs $100/month for 5x Pro usage or $200/month for 20x; Pro is $20/month, or $17/month billed annually
- First suit: June 2026: Kahn v. Anthropic, a proposed class action in the Northern District of California by one subscriber
- Second suit: September 8, 2026: a broader class action alleging Max marketing hides the weekly usage caps
- Core claim: the 5x/20x multipliers apply to five-hour session windows, while weekly limits added in August 2025 cap total use
- Status: no ruling or settlement reported; Anthropic did not comment to reporters, and the claims are unproven
What the complaints allege
The June complaint, reported by Implicator, says a single five-hour session used around 15% of the plaintiff's weekly allowance, and argues that the $200 Max 20x tier delivered only about six to eight times Pro's usage. It proposes a class of US buyers of Max 5x or Max 20x since the plans launched in April 2025 and seeks damages, restitution and changes to the marketing.
The September class action, covered by Engadget and Channel News, makes a related point: Anthropic advertises "5x or 20x more usage than Pro," but that comparison applies within session windows that reset every five hours. Max subscribers also face weekly limits, introduced in August 2025, which the plaintiffs say are not clear from the sales pages. Their lawyer says buyers had to click through several links to find the real limits.
What Anthropic says about limits
Anthropic has not commented publicly on either case. Its help pages describe the multipliers as per-session and say usage depends on conversation length and complexity, the model chosen, the features used and the effort level. In other words, Anthropic's position on paper is that limits were disclosed; the plaintiffs say the disclosure was not prominent enough. Decrypt notes that none of the allegations has been tested in court.
Our take: how to check what an AI plan really gives you
- Find both limits. Most AI plans have a short-window cap (hours) and a long-window cap (week or month). The headline multiplier usually describes only the first.
- Read the help page, not the pricing page. The pricing table is marketing; the support article is where the conditions live.
- Measure a normal week. Note when you hit caps and on which model. Heavier models and long contexts burn allowance faster.
- Compare tiers on your workload. A plan that is "4x" the price of another may not give 4x the work if a weekly cap binds first.
- Watch the cases, not the headlines. Filing a class action is easy; certification, rulings or settlements are what change terms for subscribers.
